TERMS OF SERVICE

Payment policy

Acceptable methods of payment are: check, cash and Apple Pay. All materials and goods supplied by Foresight Network Solutions shall remain the property of Foresight Network Solutions until the full invoice has been paid by the customer. Unless explicitly agreed prior to commencement of work, payment will be due in full upon completion of the work or services provided. Where a quotation has been provided, the full amount, less any payments already made, is payable. Where a quotation has not been provided, Foresight Network Solutions will advise the customer of the amount due and will post a detailed receipted invoice within 72 hours. All prices include tax at the appropriate rate. All payments must be received by Foresight Network Solutions within 20 days of the date of invoice. Any payments received after said date will be deemed late and subject to a late fee equal to 1.5 percent per month of the outstanding unpaid amount. The customer is also responsible for all attorneys’ fees, court costs, and related expenses incurred in the event payment is not made in a timely manner, and proceedings are brought by Foresight Network Solutions to collect sums owed.

Quotations

All quotations for work will be provided based on the information given to Foresight Network Solutions by the customer. Any variations to the work following the issue of the quotation and prior to commencement of work shall result in a revised quotation being issued for acceptance. For variations after work has commenced, a fixed price to cover the variation shall be agreed between Foresight Network Solutions and the customer and added to the final invoice. If requirements change due to insufficient information having been provided, defects found in existing installations, etc. The customer will be liable for any additional expense incurred. Quotations shall remain valid for acceptance by the customer for a period of one calendar month following the issue of the quotation and work is to commence within two calendar months from the date of the quotation or a new quotation will be required.

Estimates

Estimates are provided on a best practices basis only and, unless a fixed price quotation (see above) has been provided to the customer, work will be charged based upon the price of parts provided by Foresight Network Solutions plus labor which will be charged by the hour or part thereof and may include time taken to research, source and purchase any materials provided.

Unforeseen costs

The customer shall be liable to meet the cost of any additional work, services or fittings that need to be provided to rectify any event or situation which arises during the course of the works that are unexpected or are beyond Foresight Network Solutions’ control. Foresight Network Solutions cannot be held responsible for such events or situations.

Liability

Foresight Network Solutions can only be held liable for the extent of works carried out by Foresight Network Solutions. No liability shall be accepted in respect of defects in existing installations or in respect of parts not manufactured by Foresight Network Solutions. Foresight Network Solutions shall not be held responsible for any loss or damage to property, materials or injuries to individuals caused by the personal actions of the customer or other household members or guests before, during or after such works have been carried out. All advice provided by Foresight Network Solutions is offered as an opinion only and the customer accepts such opinions at their sole discretion and risk. The customer employs the services of Foresight Network Solutions at his or her sole risk at all times.

Warranty

Should any cable or connector portion of your network that was installed, added, moved or changed by Foresight Network Solutions, malfunction as a result of our work, we will correct the problem, free of charge, for up to 1 year. Should a malfunction occur, you may contact us from 8am-6pm, 7 days a week. Foresight Network Solutions maintains on-call technicians to handle your emergencies around the clock. This warranty is expressly limited to the correction of the malfunction and does not apply when misuse, abuse, damage or negligence by original purchasers or their employees, agents or representatives cause a malfunction. The warranty does not apply to existing items that were not installed, added to, changed, moved or repaired by Foresight Network Solutions or to the alteration of any item from the original design or performance standards by anyone other than a Foresight Network Solutions employee. Malfunctions caused by performance degradation due to natural breakdown by the elements (sun, weather), operation or usage being out-of-tolerance from the original equipment standards, industry standards or generally accepted standards, are also exempt from this warranty. Foresight Network Solutions shall not be liable for any damages, including incidental or consequential damages, including but not limited to expenses, cost, profits, lost savings or earnings, lost or corrupted data, or other damages resulting from use or misuse of the items installed, added, changed, moved or repaired by Foresight Network Solutions.

Term of warranty

This warranty, as well as the statute of limitations for any claim of damages for defective work or materials, is one year from substantial completion, defined as the date of final payment & acceptance by the party initiating contract. If Foresight Network Solutions performs warranty work within this period, this warranty shall be extended to the repaired or replaced work itself and be covered for one year after completion, as to that specific work.
